Terms and Conditions

1. Agreement

By creating an account, or by using the Hectix app or website (the “Service”), you agree to these Terms and Conditions and to our Privacy Policy. If you do not agree, do not use the Service.

2. Who can use Hectix

You must be at least 16 years old, and old enough to form a binding contract where you live. If you use Hectix for an organization, you confirm you are allowed to accept these terms on its behalf.

3. Your account

• Give accurate information and keep your email address up to date.
• Keep your password safe and do not share your account.
• You are responsible for everything done through your account. If you think someone else has access, sign out your devices in the app and email us at support@hectix.app straight away.

4. Your servers and what you run on them

Hectix is a tool that connects your phone to servers you choose, over SSH. It runs the commands, file changes and AI tasks that you start.

• Only connect to servers you own or are authorized to access. Accessing systems without permission may be illegal, and is forbidden on Hectix.
• You are responsible for what is run on your servers through Hectix, including commands you type, files you change, and actions an AI agent takes on your instructions.
• Keep your own backups. Commands and changes made on a server can delete or damage data, and we cannot undo them.
• Your SSH credentials stay on your device. If you lose your phone, you may need to add them again.

5. AI features

• AI features send your requests and the context you provide to a third-party AI provider, such as Anthropic or OpenAI, using your own API key or your own Claude account. Your use of those providers is also governed by their terms, and any charges they make are between you and them.
• AI output can be wrong, incomplete or unsafe. Review changes before you rely on them, especially on production systems. An AI agent may edit files and run commands in the project folder you choose, within the permissions you set.
• You must not use AI features to create anything illegal or harmful, or in breach of the AI provider’s usage policies.

6. Acceptable use

You agree not to use Hectix to:

• access, scan, attack or disrupt any system or network you are not authorized to use
• send spam, run malware, mine cryptocurrency on systems you do not own, or launch denial-of-service attacks
• store or share content that is illegal, or that infringes someone else’s rights
• break, probe or overload the Service, or get around its security or usage limits
• copy, resell or reverse engineer the Service, except where the law allows it
• pretend to be someone else, or give false information

7. Third-party services

Hectix works with services we do not control, such as your server providers, AI providers, app stores and Google sign-in. We are not responsible for those services, and their own terms apply.

8. Fees

Hectix is currently free. We may offer paid plans in the future. We will tell you the price and terms clearly before you are charged anything, and we will never move you to a paid plan without your agreement. Payments in the app may be handled by Google Play or the App Store under their terms.

9. Your content

You keep all rights to the content you put into Hectix, such as server names, AI chats and files. You give us permission to store and process that content only as needed to provide the Service to you, as described in our Privacy Policy.

10. Our rights

The Hectix app, website, name, logo and design belong to us and are protected by law. We give you a personal, non-exclusive, non-transferable right to use the app for as long as these terms allow. If you send us feedback or ideas, we may use them without any obligation to you.

11. Ending your use

You can stop using Hectix at any time, and ask us to delete your account by following the steps on the Delete your account page. We may suspend or close accounts that break these terms or put other users or the Service at risk. Where reasonable, we will tell you why first. Sections that by their nature should continue, such as disclaimers and limits on liability, continue after your account ends.

12. Disclaimers

The Service is provided “as is” and “as available”. To the extent the law allows, we do not promise that it will be uninterrupted, error-free or secure, or that AI output will be accurate, and we disclaim all implied warranties, including fitness for a particular purpose. Nothing in these terms affects rights you have as a consumer that cannot be excluded by law.

13. Limitation of liability

To the extent the law allows, Hectix will not be liable for any indirect, incidental, special or consequential damages, or for loss of data, profits, revenue or business, including damage to or downtime of your servers caused by commands or AI actions run through the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim, or 50 US dollars. These limits do not apply to liability that cannot be limited by law, such as for fraud or for death or personal injury caused by negligence.

14. Indemnity

If you use Hectix to break these terms or the law, or to access systems without permission, you agree to cover the reasonable costs and claims that result for us, to the extent the law allows.

15. Changes to these terms

We may update these terms as Hectix changes. We will change the “Last updated” date above and, for significant changes, tell you in the app or by email before they take effect. If you keep using Hectix after that, you accept the new terms.

16. Governing law

These terms are governed by the laws of the country where Hectix’s operator is established, without regard to conflict of law rules. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you may bring claims in your local courts. Before starting any formal dispute, please email us so we can try to resolve it.
